​Terms and Conditions for Monarch Website Design

1. Services Provided
   Monarch Website Design ("we," "us," or "our") provides custom website design and development services based on individual project quotes. Services may include, but are not limited to, website creation, basic SEO setup, mobile optimization, website redesigns, domain connection assistance, and ongoing hosting and maintenance.

1. Quotes and Payment Terms
   A custom quote will be provided following submission of your intake form and any initial discussions.

A non-refundable 1% deposit of the total quoted amount is required to begin work. This 1% deposit will be deducted from the final total payment upon completion of the project. Final payment for the remaining balance is due immediately before the website is published and launched live.

A monthly hosting and maintenance fee will also apply, covering server costs, security, updates, and basic support. This monthly fee is part of the ongoing service agreement.

Default Payment Terms:

• The 1% deposit is required to begin the project.

• The remaining project balance is invoiced immediately before the website launch.

• Payment is due within 3 business days of receiving the final invoice.

• Late payment will delay website launch until the balance is paid.

• Hosting fees are invoiced monthly, due on the 1st of each month.

• Clients have a 5-day grace period before the website is suspended for non-payment.

• Reactivation requires payment of the outstanding balance in full.

1. Hosting, Ownership, and Access
   All websites are hosted through Wix and managed by Monarch Website Design as part of your monthly service fee.

Full ownership of your live website and its design assets transfers to you only after:

• Full payment of the project balance is received,

• All outstanding hosting fees (if applicable) are cleared,

• And the $100 website transfer fee has been paid if transferring hosting.

If you choose to transfer hosting responsibilities away from Monarch Website Design:

• You must purchase full ownership rights to the completed website.

• A $100 transfer fee will apply before release of website files, login credentials, administrative access, or final ownership documents.

• No exceptions apply; the $100 fee is mandatory for all transfers.

Until these conditions are met, all website materials, layouts, and assets remain the sole property of Monarch Website Design.

Placeholder content and templates provided during the build process remain our property unless otherwise agreed.

If hosting fees are not paid when due, Monarch Website Design reserves the right to deactivate the website until outstanding balances are resolved.

1. Client Responsibilities
   You are responsible for providing any required business information, branding materials, text, and media assets necessary for completing the project.

Placeholder content can be provided by Monarch Website Design, but finalized client-provided content is highly recommended to ensure your website aligns fully with your brand voice and goals.

Clients are expected to provide timely feedback and participate in review stages. Lack of communication beyond 30 days may result in project cancellation without refund.

1. Revisions and Edits
   Each project includes two to three rounds of revisions during the design process.

Once revisions have been completed or revision limits have been reached, no additional changes will be made unless covered under a separate agreement.

1. Cancellation Policy
   After the non-refundable 1% project deposit is paid, you may cancel the project at any time prior to final delivery.

• The 1% deposit remains non-refundable under all circumstances.

• No refunds will be issued after the final website is delivered or published.

• If substantial progress has been made on the project, Monarch Website Design reserves the right to retain any additional fees paid for work completed.

1. Limitation of Liability
   Monarch Website Design is not liable for third-party service outages, Wix platform interruptions, changes in SEO performance, or any damages arising from the use or inability to use the delivered website.

Our total liability for any claim shall not exceed the total amount paid by the client during the 12 months preceding the claim.

1. Privacy and Security
   Monarch Website Design respects your privacy. Collected website data and user information will be securely stored and will not be used, sold, or viewed by Monarch Website Design outside of project needs.

All client data will be used solely for the purpose of delivering the services outlined in your quote and agreement.

1. Legal Protection and Indemnification
   You agree to indemnify, defend, and hold harmless Monarch Website Design, its owners, employees, contractors, affiliates, subsidiaries, and family members from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the services,

• Your violation of these terms,

• Or any harm arising from your website’s operation, content, or marketing practices.

This indemnification extends to any legal action brought by third parties, including but not limited to copyright claims, data breaches, defamation claims, and violations of applicable laws.

1. Amendments
   Monarch Website Design reserves the right to update or amend these Terms and Conditions at any time. Clients will be notified of any significant changes that may affect ongoing projects or service agreements.

1. Governing Law
   These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

By engaging in services with Monarch Website Design, you agree to these Terms in full.
